| Woodcraft "Truck ‘n Tools" Rules: NO PURCHASE NECESSARY
LIMIT ONE ENTRY PER HOUSEHOLD
1. ELIGIBILITY
The Truck ‘n Tools Sweepstakes ("Promotion")
is offered only in the United States and its territories to
legal United States residents at least 18 years old and a licensed
driver. Employees, directors and franchisees of Woodcraft Supply
Corp. ("WOODCRAFT") or SBR, Inc. and all of its subsidiary
companies, Toyota Motor Sales, U.S.A., Inc. (TMS, co-sponsor),
JET (co-sponsor), Porter-Cable (co-sponsor), those entities’ advertising
agencies, or any of the aforementioned entities’ affiliates
or subsidiaries, or the immediate family (spouse, mother,
father, sister, brother, daughter or son, regardless of where
they
live) or members of their same households (whether related
or not) of such employees, directors and franchisees are
not eligible. By entering, you agree to these Official Rules
and
the award decision of WOODCRAFT, which is final and binding
in all respects. Promotion is subject to all US federal,
state and local laws and regulations. Void where prohibited
or restricted
by law.
2. PROMOTION PERIOD
Entry forms will be accepted and must be received between 12:01
a.m. EST January 1, 2003, and April 30, 2003, 12:00 midnight
EST.
3. ENTRY
There are three ways to enter: the Store Method, the Internet
Method and the Mail-in Method. Entry forms must be filled out
completely. Limit one entry per household.
(a) Store
Method: Go to any WOODCRAFT store or the Woodworkers Club® and
request an entry form. Completely fill out the form and
turn it in to a store employee.
(b) Internet Method: To enter by Internet, go to www.woodcraft.com
and complete the registration form by following the instructions
at the web site.
(c) Mail-in Method: To enter by mail, on a 3" x 5" card
in black or blue ink, hand print your full name, complete
home address including zip code, home telephone number with
area code, email address (if available), and mail in a first
class stamped envelope to: Truck ‘n Tools Sweepstakes,
c/o Woodcraft, P.O. Box 1686, Parkersburg, WV 26102-1686.
Promoters and co-sponsors are not responsible for lost,
stolen, fraudulent, late, mutilated, incomplete, altered,
postage
due, illegible or misdirected entries.
4. DRAWING
The Promotion winners will be selected by random drawing,
by May 31, 2003, from all eligible entries received by April
30, 2003, 12:00 midnight EST. The winner will be notified
by email, telephone, overnight carrier, or regular mail within
approximately 7 days of the drawing.
5. PRIZE/ODDS
The Grand Prize consists of a new 2003 4x2 Toyota Tundra
Limited Access Cab pick-up truck, MSRP $27,465, plus
a Porter-Cable prize package (manufacturer’s list price $6,870.50),
for a total prize value of $34,335.50. Three 1st Place Prizes
will be awarded – JET Xacta Saw Package, Woodcraft
75th Anniversary Limited Edition model, with 50” Deluxe
Xacta Fence, Item #144527, valued at $1,549.99 each. One
2nd Place Prize – $75 Woodcraft gift certificate – will
be awarded at each retail store location, plus one from
all eligible Internet entries and one from all eligible
Mail-In
entries. A detailed list all prizes and their values
can be found at www.woodcraft.com. TMS, JET, Porter-Cable
and
WOODCRAFT reserve the right to make substitutions of
equal or greater value. The depiction of the vehicle
in any advertising
or promotional materials may not reflect the actual vehicle
delivered to the winner.
Odds
of winning depend on the number of eligible entries received.
Prizes
are non-transferable and no assignment,
transfer or
substitution of prize is permitted. The winner shall be
responsible for all taxes, license, title and registration
fees or other
costs, including without limitation any travel or transportation
costs, associated with winning the Vehicle (provided, however,
the Vehicle shall be delivered at no cost to the winner
to an authorized Toyota dealer or distributor in the continental
U.S. reasonably close in proximity to the winner's residence).
TMS shall not be responsible for delays in delivery of
the
Vehicle, and delivery is subject to availability. TMS,
however, shall use all reasonable efforts, subject to availability,
to deliver the Vehicle within one hundred eighty (180)
days
after receipt of the Affidavit of Eligibility, a Liability
Release, and where lawful, a Publicity Release within 5
days of notification. The winner shall bear all risk of
loss or
damage to the Vehicle after it has been delivered to the
specified delivery site. The winner must personally retrieve
the prize
vehicle within 30 days of written notification of delivery
and must present adequate personal identification and evidence
of legally required insurance (or an alternative winner
shall be selected and the original winner’s rights to the Vehicle
shall be automatically forfeited). The Vehicle will be delivered
solely with the express limited warranties set forth in the
Vehicle’s applicable Owner's Guide, which warranties
shall run for the term set forth in said Guide.
Grand
Prize winner must be available to travel to Charleston,
WV, for Woodcraft’s
Annual Retail Sales Conference and Vendor Trade Show, between
the dates of June 27 and July
1,
2003. Dates and location subject to change. The Porter-Cable
tools and the three JET Xacta Saws will be delivered to
the residences of the winners. Gift certificate winners
will
pick up their prizes at their local stores. Gift certificates
for
Mail-in and Internet entries will be mailed to the winners.
6. ANNOUNCEMENT OF WINNER
The winners names will be posted on www.woodcraft.com from
June 2, 2003, to December 31, 2003. Names of the winners
may also be attained by sending a self-addressed stamped
envelope to: Truck ‘n Tools Winner, c/o Woodcraft,
PO Box 1686, Parkersburg, WV 26102-1686.
7. GENERAL CONDITIONS
Winners must execute and return an Affidavit of Eligibility,
a Liability Release, and where lawful, a Publicity Release
within 5 days of notification. Failure to return documents
in a timely manner, or if prize notification or prize is
returned as non-deliverable, may result in disqualification
with an alternate winner selected. The alternate winner will
be selected by random drawing from all remaining eligible
entries received by April 30, 2003. Where permitted by law,
winner (and in those instances when interim drawings have
taken place, potential winners who have been selected in
the interim drawings) agrees to grant to WOODCRAFT the right
to print, publish, broadcast and use worldwide in any media
now known or hereafter developed, including but not limited
to the world wide web, at any time or times, the winner's
name, portrait, picture, voice, likeness and biographical
information as news or information and for advertising and
promotional purposes without additional consideration; and
further without such additional compensation, appear for,
or provide biographical information for use in, any presentation
or other activity which may include filming/audio/video/
electronic or other recordings and/or interviews, as may
be determined from time to time by WOODCRAFT. Failure to
make such appearances or grant such rights may result in
disqualification with an alternate winner or potential winner
selected; and while not obligated to do so, WOODCRAFT may
in its sole discretion, bear such reasonable costs and expenses
which WOODCRAFT, in its sole discretion, deems appropriate
for winners or potential winners to appear for a presentation
or other activity.
Further,
by accepting a prize, each winner agrees to release and hold
harmless
WOODCRAFT, TMS, SBR, Inc., JET, Porter-Cable,
their employees, shareholders, directors and franchisees and
all of its affiliates, subsidiaries, advertising and promotion
agencies and their respective directors, officers, employees,
representatives and agents from any and all liability for any
injuries, loss or damage of any kind to person, including death,
and property, arising in whole or in part, directly or indirectly,
from acceptance, possession, use or misuse of a prize, participation
in any Promotion related activity, or participation in this
Promotion. However, TMS shall be solely responsible for any
warranties specifically set forth in the applicable Owner's
Guide for the Vehicle. Standard manufacturer’s warranties
apply to JET and Porter-Cable products. Void where restricted
or prohibited by law.
WOODCRAFT reserves the right, at its sole discretion, to
disqualify any individual it finds, in its sole discretion,
to be tampering with the entry process or the operation of
the Promotion or web site; to be in violation of the Official
Rules; or to be acting in a non-sportsmanlike or disruptive
manner, or with intent to annoy, abuse, threaten or harass
any other person.
WOODCRAFT also reserves the right, at its sole discretion,
to cancel this Promotion.
WOODCRAFT will prosecute any fraudulent activities to the
full extent of the law.
8. LIMITATIONS OF LIABILITY FOR WEB ACCESS
WOODCRAFT is not responsible for any incorrect or inaccurate
information, whether caused by web site users, or tampering
or hacking, or by any of the equipment or programming associated
with or utilized in the Promotion and assumes no responsibility
for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure,
theft or destruction or unauthorized access to the web site.
WOODCRAFT is not responsible for injury or damage to participants'
or to any other person's computer related to or resulting
from participating in this Promotion or downloading materials
from or use of the web site. If, for any reason, the Promotion
is not capable of running as planned by reason of infection
by computer virus, worms, bugs, tampering, unauthorized intervention,
fraud, technical failures, or any other causes which, in
the sole opinion of WOODCRAFT, could corrupt or affect the
administration, security, fairness, integrity or proper conduct
of this Promotion, WOODCRAFT reserves the right at its sole
discretion to cancel, terminate, modify or suspend the Internet
portion of this Promotion for any drawing(s) and select the
winner from store and regular mail-in entries and Internet
entries received for that drawing prior to the action taken.
IN NO EVENT WILL WOODCRAFT, TMS, SBR INC., JET, PORTER-CABLE,
THEIR SHAREHOLDERS, AFFILIATES, SUBSIDIARIES, RELATED COMPANIES,
OR ITS FRANCHISEES, THEIR ADVERTISING OR PROMOTION AGENCIES
OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES
AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES
OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL
OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE
OF INTERNET SITE www.woodcraft.com OR THE DOWNLOADING FROM
AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE.
9. DISPUTES
As a condition of participating in this Promotion, participant
agrees that any and all disputes which cannot be resolved
between the parties, and causes of action arising out of
or connected with this Promotion, shall be resolved individually,
without resort to any form of class action, exclusively,
before a court located in the City of Parkersburg, West Virginia,
having competent jurisdiction, which Court shall apply the
laws of the State of West Virginia without regard for doctrines
of Conflict of Law. Further, in any such dispute, under no
circumstances will participant be permitted to obtain awards
for, and hereby waives all rights to claim punitive, incidental
or consequential damages, or any other damages, including
attorneys' fees, other than participant's actual out-of-pocket
expenses (i.e., costs associated with entering this Promotion),
and participant further waives all rights to have damages
multiplied or increased.
